Overview

Welcome to TheOxyShop. TheOxyShop is a brand owned and operated by JAM BILLION PVT. LTD., a company incorporated in India. In these Terms, "TheOxyShop", "we", "us" and "our" refer to JAM BILLION PVT. LTD., and "you" refers to anyone who visits the website or buys from it.

We run the online store at https://theoxyshop.com (the "Store"), where we sell OxyPop and a curated range of lifestyle, wellness and everyday-living products (the "Products"). OxyPop is a product line sold under the TheOxyShop brand.

These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and any other policies shown on the Store, govern your use of the Store and your purchase of Products. Please read them carefully. By browsing the Store or placing an order, you agree to these Terms. If you do not agree, please do not use the Store.

Section 1 – Eligibility and Account

You must be at least 18 years old and legally able to enter into a binding contract under Indian law to place an order. If you are under 18, you may use the Store only under the supervision of a parent or legal guardian, who will be responsible for any order placed.

When you place an order or create an account, you agree to give us accurate, current and complete information and to keep it updated.

You are responsible for keeping your account login details confidential and for all activity under your account. Please tell us promptly at info@theoxyshop.com if you believe your account has been used without your permission. You may not transfer, sell or share your account with anyone else.

Section 2 – Our Products

We make reasonable efforts to ensure that product names, descriptions, images, ingredients, prices and other details on the Store are accurate. Actual colour, packaging and appearance may differ slightly from what you see on your screen, and packaging may change from time to time.

Product details, availability and our range may change. We may discontinue a Product or limit the quantity available to any customer or location.

Product use and safety. Please read the label, directions, ingredients and warnings on the packaging and product page before use, and use each Product only as directed. In particular:

Keep Products out of reach of children unless the label says otherwise.
Check the ingredient list if you have any allergies or sensitivities, and stop using a Product if you experience any discomfort or adverse reaction.
If you are pregnant, nursing, or have a medical condition, consult a qualified healthcare professional before use.

Our Products are lifestyle and wellness products. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Information on the Store is for general information only and is not medical advice.

Section 3 – Orders and Cancellation

When you place an order, you are making an offer to buy the selected Products at the price shown at checkout. An order is accepted only when we confirm dispatch or otherwise confirm acceptance.

We may decline, limit or cancel an order, for example if a Product is out of stock, there is a pricing or listing error, payment cannot be verified, the delivery address is not serviceable, or we reasonably suspect fraud or misuse. If we cancel an order after you have paid, we will refund the full amount to your original payment method.

You may cancel an order before it is dispatched by contacting us at info@theoxyshop.com or +91 92895 97900 with your order number. Once an order has been dispatched, the Refund Policy applies.

Products are sold for personal or household use only and not for resale.

Section 4 – Prices, Taxes and Payment

All prices are in Indian Rupees (INR) and include applicable GST unless stated otherwise. Shipping charges, if any, are shown at checkout before you pay. Offers such as free shipping above a minimum order value apply as described on the Store at the time of purchase.

Prices, discounts and promotions may change without notice, but the price that applies to your order is the price shown at checkout when you place it. Promotions may carry their own terms; if they conflict with these Terms, the promotion terms apply to that promotion.

Payments are processed securely by third-party payment gateways. We do not store your full card, UPI or bank details. You confirm that you are authorised to use the payment method you provide. Cash on delivery, where offered, is available only for eligible orders and locations.

A GST-compliant tax invoice will be issued in the name of JAM BILLION PVT. LTD. for each order.

Section 5 – Shipping and Delivery

We deliver to serviceable locations within India, through our courier partners. Estimated delivery times are shown at checkout and in your order updates; they are estimates and may be affected by courier operations, weather, public holidays or other events outside our control.

Please provide a complete and accurate delivery address and phone number. If an order is returned to us because of an incorrect address, repeated failed delivery attempts or refusal at delivery, we may deduct the shipping cost from any refund or charge for re-shipping.

Ownership of and risk in the Products pass to you on delivery.

If your order arrives damaged, tampered with or incorrect, please contact us within 48 hours of delivery with your order number and photos or a video of the product and packaging, so we can help.

Section 6 – Returns and Refunds

Returns, replacements and refunds are governed by our Refund Policy (https://theoxyshop.com/policies/refund-policy). For hygiene and safety reasons, opened or used Products may not be eligible for return unless they were damaged, defective or incorrect on delivery.

Section 7 – Intellectual Property

All content on the Store, including the TheOxyShop and OxyPop names and logos, product names, packaging artwork, text, photographs, videos, graphics and the design of the Store, is owned by or licensed to JAM BILLION PVT. LTD. and is protected by Indian and international intellectual property laws.

You may use the Store for personal, non-commercial purposes only. Without our prior written permission, you must not copy, reproduce, modify, distribute, publish or commercially use any content from the Store, or use our names, logos or brand assets in any way.

Shopify's name and logo are trademarks of Shopify. Other names and logos on the Store belong to their respective owners.

Section 8 – Reviews and Feedback

If you submit a review, rating, photo, video, testimonial, product suggestion or other content ("Feedback"), you confirm that it is your own honest opinion and experience, that you have the right to share it, and that it does not infringe anyone's rights or break any law.

You give us a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, display and share your Feedback, including your first name or username, to operate and promote the Store and our Products. We are not obliged to pay for, keep confidential or respond to Feedback.

We may moderate, edit for length or remove Feedback that we reasonably consider unlawful, offensive, misleading, fake or unrelated to the Product. We do not publish reviews in exchange for payment, and any incentivised review will be clearly identified.

Section 9 – Communications

By placing an order, you agree that we may contact you by email, SMS, WhatsApp or phone about your order, delivery and account.

We will send you offers and promotional messages only if you have opted in, for example by joining our club or newsletter. You can unsubscribe at any time using the link in our emails, by replying STOP where available, or by contacting us.

Section 10 – Third-Party Services and Links

The Store uses third-party services for payments, shipping, analytics and customer support, and may include links to third-party websites and social media platforms. These third parties have their own terms and privacy policies, and we are not responsible for their content, practices or availability, except as required by law.

Section 11 – Relationship with Shopify

TheOxyShop is powered by Shopify, which enables us to provide the Store to you. However, any sales and purchases you make in our Store are made directly with JAM BILLION PVT. LTD. (TheOxyShop). By using the Store, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and TheOxyShop, including any injury, damage, or loss resulting from purchased Products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with TheOxyShop.

Section 12 – Privacy

Your personal information is handled in accordance with our Privacy Policy (https://theoxyshop.com/policies/privacy-policy), which forms part of these Terms. Because the Store is hosted by Shopify, some personal information is also processed by Shopify under its own privacy policy.

Section 13 – Errors, Inaccuracies and Omissions

The Store may occasionally contain errors in product descriptions, pricing, promotions, availability or shipping charges. We may correct such errors at any time. If an error affects an order you have placed, we will contact you and give you the option to continue at the correct price or cancel the order for a full refund.

Section 14 – Prohibited Uses

You may use the Store only for lawful purposes. You must not:

use the Store for any fraudulent, unlawful or harmful purpose, or to violate any applicable law;
provide false information, impersonate any person, or place fake or fraudulent orders;
infringe our intellectual property or the rights of any third party;
post false, misleading or fake reviews, or harass, abuse or defame any person;
upload or transmit viruses or other malicious code;
attempt unauthorised access to the Store, other accounts, systems or data;
collect or track the personal information of others;
buy Products in bulk for resale, or misuse offers, coupons or referral programmes; or
interfere with or disrupt the security or operation of the Store.

Section 15 – Automated Access and Agents

You must not use bots, scrapers, crawlers or other automated tools, including AI agents, to access, monitor or copy the Store without our written permission. Any automated agent that does access the Store must clearly identify itself as automated, must not disguise itself as a human user or bypass CAPTCHAs or other access controls, and must stop if we ask it to. We may use technical measures to limit or block automated access.

Section 16 – Suspension and Termination

We may suspend or terminate your account or access to the Store if you breach these Terms, misuse the Store or engage in fraudulent or unlawful activity. You may close your account at any time by contacting us. Sections that by their nature should continue, including Intellectual Property, Reviews and Feedback, Limitation of Liability, Indemnity and Governing Law, will continue after termination.

Section 17 – Disclaimers

We try to keep the Store available, secure and accurate, but we do not guarantee that it will always be uninterrupted, timely or error-free.

Except as expressly stated in these Terms or on the Product label, and to the extent permitted by law, the Store and Products are provided without any additional warranties. Nothing in these Terms excludes or limits any right you have as a consumer under the Consumer Protection Act, 2019 or any other law that cannot be excluded.

Section 18 – Limitation of Liability

To the extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, such as loss of profit or data, arising from your use of the Store or Products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law.

Section 19 – Indemnity

You agree to indemnify JAM BILLION PVT. LTD., its directors, employees and service providers against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Store, or your violation of any law or third-party rights, except to the extent caused by our own fault.

Section 20 – Force Majeure

We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, government action, courier or network disruptions, or failures of third-party services.

Section 21 – Governing Law and Disputes

These Terms are governed by the laws of India. Subject to your rights to approach a consumer commission under the Consumer Protection Act, 2019, the courts at New Delhi, India will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Store. We encourage you to contact us first so we can try to resolve any issue informally.

Section 22 – Grievance Redressal

If you have a complaint about an order, a Product or these Terms, please email us at info@theoxyshop.com with your order number and details of the issue. We will acknowledge your complaint within 48 hours and aim to resolve it within one month of receipt, in line with the Consumer Protection (E-Commerce) Rules, 2020.

Section 23 – General

Severability. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the rest of the Terms will remain in effect.

Waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

Entire agreement. These Terms, together with the policies they refer to, form the entire agreement between you and us about your use of the Store and replace any earlier versions.

Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours in connection with a merger, restructuring or sale of business, without reducing your rights.

Headings. Headings are for convenience only and do not affect the meaning of these Terms.

Section 24 – Changes to These Terms

We may update these Terms from time to time. The latest version will always be on this page with its "Last updated" date. Changes apply to orders placed after the updated Terms are posted, and your continued use of the Store means you accept them.
